Boundary Disputes

Most boundary disputes involve a few centimetres of land between domestic gardens or commercial buildings, often as a result of a disputed boundary line along a hedge or fence, or possibly when an extension has been or is proposed to be built.

Often the land involved is worthless in monetary terms but sometimes for city centre commercial areas, the land can be extremely valuable.

Although potentially simple to resolve, such disputes often end up in court, due mainly to a lack of understanding of the issues involved. Rights of way and other easements are often linked to these matters. Some of these rights are granted in writing, or acquired over time.

We offer expert advice on boundary matters, assessing the evidence and offering guidance thus allowing the parties to the dispute to hopefully reach an informed decision before engaging in expensive legal actions.

Where a boundary dispute is resolved we are able to provide Land Registry compliant plans to confirm the position as a “determined boundary”.

WHAT OUR CLIENTS SAY

Professional and pragmatic advice from an experienced building surveying practice who we are always happy to recommend to our clients.

Peacock Stevens have continued to deliver a pro-active and professional service during the years that I have worked with them. Their communication throughout the process is excellent, delivering the projects in an efficient and timely manner. I would have no hesitation in recommending their service.

We have appointed Peacock Stevens on numerous projects ranging from retail conversions and extensions to large-scale petrol filling station developments. They have continuously delivered in terms of their professional and diligent approach, and we look forward to working with them again on future projects.

I recently used Peacock Stevens when looking to purchase a new house. In the end I instructed two surveys as the depth and quality of the report on the first property identified defects that would have meant significant costs to me, meaning I did not proceed.

I am pleased that my second choice was defect free and the quality and detail in the survey was again of the highest standard.

Peacock Stevens recently carried out an RICS Building Survey for me on a house I was looking to purchase. The report was thorough and detailed but was also easy to understand. We are very happy in our new home.

An excellent and comprehensive report and we will take heed of its findings. We are proceeding with the purchase and hopefully all will go according to plan. Thank you and with best wishes
